Negotiated settlements become written Separation Agreements that the Court reviews for fairness. If no agreement is reached, the case proceeds to trial, where the Court decides matters such as custody, support, and the division of assets based on statutory factors and case precedent. Appealing a judge's decision is difficult given the broad discretion the trial court enjoys.
Every client receives a retainer agreement detailing billing rates and terms. Clients are ultimately responsible for fees, though in some cases the Court may order the spouse to pay. The retainer agreement should always be reviewed carefully before signing.

Filing & Service
A divorce begins with a Complaint. The Court issues a Summons to be served on your spouse — by an attorney or through voluntary acceptance. If your spouse files first, we respond with an Answer and, when appropriate, a Counterclaim.
Pretrial Motions
Motions request temporary relief — support, custody, attorney fees, or restraining orders. Court orders entered on these motions are temporary and remain in effect until the final hearing.
Discovery & Financial Statements
Discovery uncovers the financial and non-financial facts that drive the case. The Court requires sworn Financial Statements detailing income, assets, and liabilities before granting any divorce or financial order.
Settlement or Trial
Negotiated settlements become written Separation Agreements reviewed by the Court for fairness. If no agreement is reached, the case proceeds to trial, where the Court decides custody, support, and asset division.
